Town to Farm Fiber: Terms of Service By using Town to Farm Fiber ("the Service"), you agree to be bound by the following terms and conditions (“Terms of Service”). Town to Farm Fiber reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to these Terms. Continued use of the Service after any such changes shall constitute your consent to such changes. Violation of any terms below may result in the termination of your access to the Service. . Account Terms
- Registration: You must provide your legal full name, a valid email address, and any other information requested in the Town to Farm Fiber Service Agreement as part of the signup process.
- Lawful Use: You may not use the Service for any illegal or unauthorized purpose.
2. Payment and Refunds
- Billing Cycle: The Service is billed on a monthly basis. You will receive an electronic invoice at the beginning of each service month, with payment processed 10 days later.
- Accepted Methods: Payments must be made via credit card or electronic check/ACH. We accept Visa, Mastercard, Discover, and American Express.
- Failed Payments: A $25.00 service charge will be assessed for declined credit cards or returned checks.
- Termination for Non-Payment: Services will be terminated if payment cannot be collected within 14 days of the billing date.
3. Cancellation and Termination
- Right to Terminate: Town to Farm Fiber, at its sole discretion, reserves the right to suspend or terminate your account and refuse any current or future use of the Service for non-payment or any other violation of these terms at any time and without notice.
- User Cancellation: You may cancel your Service at any time by contacting Town to Farm Fiber directly.
4. General Conditions & Usage
- Server Hosting: You may not host a public server that is (a) for commercial purposes, or (b) considered by Town to Farm Fiber to be high-traffic, unless your specific plan includes a statically assigned public IP address.
- Resale Prohibited: Town to Farm Fiber Internet Service cannot be resold or used to provide an Internet hotspot to others on an ongoing basis.
- Software & Security: Town to Farm Fiber maintains sole responsibility for the software supporting the Service. You agree not to attempt to access, modify, bypass, or damage any software or security measures maintained by the company.
- Site Access: You agree to allow Town to Farm Fiber personnel and its partners reasonable access to your site for equipment maintenance. If you are a tenant, you are responsible for obtaining appropriate authorization from your landlord.
- Equipment Performance: Town to Farm Fiber does not warrant the performance of any equipment or software provided by the company or its partners.
- Non-Transferable: Service is tied to a valid Town to Farm Fiber account and cannot be transferred to another party.
5. Limitation of Liability
You expressly understand and agree that Town to Farm Fiber shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages—including loss of profits, goodwill, data, or other intangible losses—resulting from:
- The use or inability to use the Service.
- Unauthorized access to or alteration of your transmissions or data.
- Statements or conduct of any third party on the Service.
- Any other matter relating to the Service.
Note: Where Town to Farm Fiber can be held liable, total liability is strictly limited to the amount of the monthly service fees paid by the customer.
6. Legal Provisions
The failure of Town to Farm Fiber to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right. This Agreement constitutes the entire agreement between you and Town to Farm Fiber. If any provision is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that the remainder of the Agreement remains in full force and effect.
